FamiJo Legal
Terms of Use
Updated October 12, 2026
These Terms govern use of FamiJo, a personal and family journaling service operated by VAV Apps LLC. FamiJo is not a medical, therapy, emergency, safety-monitoring, or health-diagnostic service.
1. Agreement and operator
FamiJo is operated by VAV Apps LLC ("VAV Apps," "we," "us," or "our"). These Terms of Use ("Terms") are a binding agreement between you and VAV Apps governing your access to and use of the FamiJo website, mobile applications, and related services (collectively, the "Service").
By affirmatively selecting the agreement checkbox and completing account registration or the updated-terms acceptance process, you agree to these Terms and acknowledge receipt of the Privacy Policy and Consumer Health Data Privacy Policy. Merely opening a public page, downloading the app, or remaining silent does not constitute acceptance of a revised agreement. If you do not agree, do not continue using account features that require acceptance. You may still contact us about your data, exercise applicable rights, and cancel a subscription through its billing provider. For questions, contact support@famijo.com.
Acknowledging a privacy notice is not a blanket authorization for every possible use of personal information. These Terms do not replace any separate, specific consent, parental verification, or authorization required by applicable law. No provision waives a privacy right or other protection that cannot lawfully be waived.
2. Eligibility, adult accounts, and profiles for children under 13 years old
You must be at least 13 years old to create an independent FamiJo account. During account creation, FamiJo asks for your birth month and year (never the day) to confirm this requirement; earlier versions of the app asked you to confirm it instead. If you are under the age of majority where you live, you may use an independent account only with the permission and supervision of a parent or legal guardian.
A child under 13 years old may use FamiJo only through a profile created and controlled by a parent, legal guardian, or other adult with legal authority (an "Authorized Adult") within that adult's own account. A child profile for a child under 13 years old is not a separate child-owned account and has no email address or password of its own. Where FamiJo offers it and the Authorized Adult switches it on, the child may sign in to write in that profile with the family code and a passcode the adult chooses (a "child sign-in", described below). A child profile and its sign-in may not be used to make payments or plan purchases, invite others, or independently control sharing or account settings.
You represent and warrant that all registration information is accurate, that you have authority to create and manage every profile or group you create, and that you will keep your account credentials secure. You are responsible for activity taken through your account and for the people to whom you grant access. Do not create, use, or help operate an independent FamiJo account for a child under 13 years old.
A higher local age threshold, parental-authorization requirement or restriction on sensitive-data processing takes precedence over the product minimum. Age confirmation and agreement to these Terms do not replace a separate verification or consent process required by law. Access in a country does not by itself establish eligibility for every feature.
Child sign-in. An Authorized Adult who has created a child profile for a child under 13 years old may, where FamiJo offers it, give that child a sign-in to write in that profile from the child's own device. The sign-in is switched on only after FamiJo emails the Authorized Adult a notice describing what is collected from the child and the adult confirms consent using the link in that email while signed in to the same account; a second email follows with a way to stop it. The child's sign-in is not a separate account: it exists within the Authorized Adult's account and uses the Authorized Adult's plan. It cannot invite anyone, share or post anything, join groups, make payments or plan purchases, contact support or change account settings; it can send requests only to the Authorized Adult. The Authorized Adult may change the passcode, sign the child out, pause or delete the sign-in at any time, and is responsible for the family code and passcode, for who in the household uses them, and for keeping the child's birth month and year correct. FamiJo may refuse, pause or end a child sign-in where the law requires, and pauses it when FamiJo's notice to the Authorized Adult changes until the adult confirms the new notice.
A child's own pages. The Authorized Adult may give the child a second journal that only the child reads day to day ("own pages"). The Authorized Adult keeps the right to review it and download a copy of its text at any time from Parent controls, and to delete it together with the child's sign-in; FamiJo records each review and download and shows the child that it happened.
Asking a grown-up. Where FamiJo offers it and the Authorized Adult has switched it on, a signed-in child can ask the Authorized Adult to share a journal day outside FamiJo. Nothing is sent unless the Authorized Adult sends it, from the adult's own device, to people the adult chooses, and each ask is decided on its own. FamiJo tells the Authorized Adult about every ask in the app and by email. Once sent, the app used and the people who receive it keep their copy under their own terms.
A child's own account. Accounts are for people 13 and over. If a child tells FamiJo in the app that they are under 13, FamiJo freezes the account at once; if FamiJo learns it another way, FamiJo suspends the account. A parent or legal guardian may then, within 14 days, move the child's journal into a child profile in the parent's own account, with the consent described in the Privacy Policy; otherwise FamiJo deletes the account and everything in it.
3. Responsibilities for child and teen journals
Only an Authorized Adult may create or manage a child profile. Before creating or changing a profile for a child under 13 years old, the Authorized Adult must affirm that they are the child's parent, legal guardian, or otherwise legally authorized to act for the child; that they have reviewed the Terms and Privacy Policy; and that they will manage access, sharing, devices, photos, saved copies, journal PINs, and co-author permissions (co-authors are people invited to write in and help manage a journal; earlier versions of these Terms called them co-managers). FamiJo records that affirmation with the account identifier, timestamp, and child-profile acknowledgment version. It is an attestation by the adult, not independent proof of parental or legal-guardian status. If applicable law requires verifiable parental consent or another consent process, the attestation does not replace it and VAV Apps may restrict the profile until that process is completed.
Use the minimum child information reasonably needed for the profile. Avoid entering a child's full legal name, home or school address, phone number, personal email, precise location, government identifier, medical record, or other sensitive information unless you have a lawful basis. FamiJo asks for a child's birth month and year (never the day), so that what changes at 13 happens in the right month; keep them accurate. A journal created earlier may hold an age in whole years or a full birth date until the adult adds the month and year; with only an age in whole years, FamiJo begins the transition review at age 12 to prepare for age 13. At 13, a child sign-in ends: FamiJo switches it off and tells the Authorized Adult, and nothing is deleted; the journal can be handed off to the teen's own account, or the Authorized Adult can continue managing it with the teen's agreement. Do not rely on an automated reminder as a substitute for your responsibilities.
A managed child profile can be accessed by the adult account holder, the co-authors or groups the adult authorizes, and, with a child sign-in, the child. A child's own pages are read day to day only by the child; the adult reviews them through Parent controls. Do not use a managed profile to secretly monitor, pressure, embarrass, expose, or otherwise misuse a child's personal information. The Authorized Adult must promptly review and remove access or sharing that is no longer appropriate and may request access to or deletion of the child's profile information through Settings or support@famijo.com, subject to identity verification and applicable law.
Before continuing management at or after age 13, including when a journal is first created for a teen, the Authorized Adult must either arrange a recipient-accepted handoff or affirm that the teen has knowingly and voluntarily agreed to the adult's continued management and that the adult has all authority otherwise required by applicable law. Explain who can access the journal, what may be shared, and how the teen may ask to stop. Agreement must be specific to the intended management and sharing, free from coercion, and continuing; do not infer it from silence. FamiJo records the account making the affirmation, the choice, time, and acknowledgment version, not independent verification that the teen agreed.
You represent and warrant that your statements concerning age, identity, guardianship, custody, consent and other authority are truthful and not misleading. You are responsible for obtaining, maintaining and, where reasonably necessary, demonstrating the permissions and lawful basis required for your own acts. If permission is withdrawn, denied or disputed, or your legal authority ends, promptly stop affected access, collection and sharing; remove co-author permissions and inappropriate shared copies under your control; and, subject to applicable law and the teen's valid directions, delete the managed journal or arrange an authorized transfer. An invitation is not a completed transfer and does not authorize continued management. Contact support@famijo.com if a dispute, legal hold or safety concern prevents resolution. Do not destroy records you are legally required to preserve or transfer information to an unauthorized person.
To the maximum extent permitted by applicable law, VAV Apps is not responsible for loss or claims caused solely by your fraudulent or materially inaccurate attestation, your unauthorized disclosure, or your failure to honor a valid withdrawal of permission, to the extent not caused or contributed to by VAV Apps' own acts or omissions. This allocation does not excuse VAV Apps from its own privacy, security, consumer-protection or other legal duties; waive a child's or teen's non-waivable rights; or exclude liability that cannot lawfully be excluded. VAV Apps may investigate, restrict access or sharing, or suspend a profile when reasonably necessary to protect a child, comply with law or address credible evidence of unauthorized processing.
A handoff requires an existing eligible FamiJo account and affirmative acceptance by the intended recipient while signed in to that account. The invitation alone does not change ownership or attest that the recipient accepted. On acceptance, the recipient may merge entries into their main journal with a journal-migration source label. The default gives priority to the recipient's existing entries; the recipient may instead prioritize incoming entries after reviewing the displayed limits. The photos-per-day limit of the recipient's plan applies to newly attached photos. Previously saved attachments above a changed limit need not be deleted. Content that does not fit, and original entries affected by the merge, remain in the recipient's private read-only transfer archive rather than being silently discarded. Transferred text and text in transfer archives use the recipient's main-journal encryption configuration, including their journal PIN when configured. Changing the PIN updates these records; destructive PIN recovery also removes PIN-encrypted transfer archives. Groups, events and to-dos, co-author access and automatic sharing are not transferred. A child's own pages are handed off together with the journal of the child's sign-in, each as its own accepted transfer. Previously shared posts and copies held by other recipients are not recalled. A handoff does not transfer copyright or other rights that the parties do not possess. Account and data-deletion rights remain available.
An adult's acknowledgment does not establish that the Service is legally permitted to collect information directly from a child. Do not allow a child under 13 years old to independently submit personal information unless a legally sufficient parental-consent process required for that use has been completed. VAV Apps remains responsible for its own obligations under applicable children's privacy laws; those obligations are not transferred to a parent by these Terms. An age-13 transition does not extinguish a teen's privacy rights or override custody orders or other legal restrictions.
4. Your content and limited license to operate the Service
You retain ownership of the journal entries, photos, posts, events, reminders, profile information, and other content you submit to the Service ("User Content").
You decide what to record and whom to give access to it. You are not required to provide a medical history, diagnosis, or mental-health condition to create an account or use the Service. If you choose to include sensitive information, use the minimum detail you consider appropriate and ensure you have lawful authority to submit or share information about another person. You are responsible for your content and sharing choices, subject to applicable law; this responsibility does not transfer VAV Apps' own privacy, security, or other legal obligations to you.
You grant VAV Apps a limited, non-exclusive, worldwide, royalty-free license, sublicensable solely to service providers acting for us, to host, store, reproduce, encrypt, format, transmit, display, back up, restore, and otherwise process User Content only as reasonably necessary to deliver and maintain the Service features you choose, honor your sharing choices, provide support you request, protect the Service, and comply with law. This is not a license to publish private entries, use them in advertising, or train unrelated artificial-intelligence models.
We do not acquire ownership of User Content and do not sell User Content for advertising, marketing, or monetary resale. This license ends when the applicable User Content is deleted from active systems, except to the extent copies must remain temporarily in backups, logs, or records as described in the Privacy Policy or required by law.
You must own or have the permissions and lawful basis necessary to upload and share User Content, including photographs of other people and information about children. Do not upload intimate images without the depicted person's valid consent, confidential records you are not authorized to disclose, or copyrighted material you have no right to use. Another person's permission to take a photograph does not necessarily include permission to share it.
5. Sharing and third-party recipients
The Service lets you share content with family members, co-authors, groups, invitees, or external applications when you choose to do so. You are responsible for selecting recipients and for ensuring that you have the right to share the content with them.
People who receive shared content may save, copy, screenshot, forward, or disclose it outside FamiJo. We cannot control a recipient's actions after you share content. Review your group membership, co-author roles, and sharing settings regularly and remove access when it is no longer appropriate.
Independent third-party services and platforms you choose to use have their own terms and privacy practices. VAV Apps does not control those independent services or guarantee their availability or conduct. This does not exclude responsibility for VAV Apps' own acts or omissions, its handling of a sharing instruction, its selection or use of service providers, or any responsibility that applicable law does not permit it to exclude.
Removing a member, changing visibility, or deleting a post cannot recall a recipient's exported or downloaded copy. Adding co-authors, journal ownership transfers, invitation acceptance, external sharing and a calendar link can change who has access; review the recipients and any confirmation screen before proceeding. Do not use a shared account as a substitute for individual access controls.
Calendar link. If you turn on the calendar link in Settings > Calendar, anyone who has the link can read the events and to-dos it includes without signing in, and each calendar app or service you add it to, such as Google Calendar or Apple's Calendar, keeps a copy under its own terms. You are responsible for where you put the link: keep it private, and reset it in Settings > Calendar if it may have been shared. Unless you switch them off, it includes the family events and to-dos other people share with a group you are in (their titles, dates and times, not their notes), so do not add it to a calendar that people outside those groups can see. In the same way, family events and to-dos you share with a group can appear, without their notes, in the calendar links of the people in it. Turning the link off stops updates but does not delete the copies a calendar already has; remove the FamiJo calendar there too.
6. Journimal and journal reflections
Journimal is an optional, playful journal companion. It uses limited activity signals, such as when and how often you write, how many words and lines, voluntary day pins, the presence of photos or events, tracker progress and, for your own Journimal, the kinds of journal you keep, your family groups and how often you post to them, to select a companion or reflection. It counts words and lines; it does not interpret what you write. It is not a medical, mental health, wellness, mood, diagnostic, therapeutic, personality, or safety assessment.
Journimal does not interpret the content of free-form journal text or photos to infer diagnosis, treatment, health status, mental health status, clinical risk, emergency risk, biometric identity, pregnancy status, reproductive health status, or personality. Do not rely on FamiJo to identify self-harm, abuse, emergencies, illness, medication needs, or any other condition or risk.
Recording health-related experiences in FamiJo does not create a physician-patient, therapist-client, or other professional-care relationship with VAV Apps. FamiJo does not undertake clinical review of entries or provide medical advice, treatment, or emergency intervention. These limitations describe the Service; they do not waive applicable consumer rights, required data safeguards, or liability that cannot lawfully be excluded.
If you are in danger, believe someone may be in danger, or need medical, mental health, or emergency assistance, contact local emergency services, a qualified professional, or an appropriate crisis resource immediately. You can turn Journimal off in Settings; doing so stops future Journimal updates but does not delete existing journal content.
7. Account security and data availability
You are responsible for protecting your password, journal PIN, device passcode and recovery email. Do not share them with anyone you do not intend to access your account or content. Notify us promptly at support@famijo.com if you believe your account has been accessed without authorization.
FamiJo supports importing dated journal text in its documented CSV or plain-text format into your main journal, subject to access and size limits. Review the preview, skipped dates and validation results before confirming. This is not a full backup restore, a photo import, or a guarantee of compatibility with another service's export. Keep the source file and check the results. You must have authority to import the content; the same content, privacy and sharing rules apply to imported entries. FamiJo does not currently offer personal cloud backups or journal-file exports. You may request a copy of your personal data through Settings or support, subject to identity verification and applicable law. These product limitations do not restrict statutory data-access or portability rights.
Delete data (Settings > Privacy & data) moves the days of every journal you keep, with their photos, events, to-dos and family posts, into a trash for 30 days, during which Bring it all back restores them; after 30 days they are deleted. It does not delete side journals, family groups or your account, each of which has its own control. Like Delete my account, it needs your password or a code we email you.
FamiJo is not an archival, records-retention, emergency, or disaster-recovery service. Keep an independent copy of irreplaceable records, photos, and memories. Backups reduce risk but do not eliminate it, and no online service can guarantee that data will never be lost, corrupted, delayed, exposed, deleted, altered, or unavailable.
Availability and recovery can be affected by device loss or compromise, user error, forgotten credentials or passphrases, network or power failures, software defects, maintenance, third-party platform or cloud-provider outages, malicious attacks, or events beyond our reasonable control. You are responsible for reviewing your content and maintaining any independent copies you need.
Force majeure: to the extent permitted by applicable law, neither party is responsible for a delay or failure to perform only to the extent directly caused by an extraordinary event beyond that party's reasonable control that could not reasonably have been prevented or overcome with appropriate care. The affected party must take reasonable steps to mitigate the effects and resume performance. A provider outage or cyberattack is not automatically an excuse for inadequate safeguards or avoidable failure. This provision does not excuse legally required privacy, security or incident-notification duties, or restrict mandatory cancellation, withdrawal or refund rights.
Photos may be resized, compressed, converted, or represented by thumbnails or references for delivery. Do not assume that an uploaded photo retains its original resolution, metadata, file format, or archival quality. Keep original photographs separately; a link or thumbnail cannot recover an original that is no longer available at its storage location.
Photo attachments are not encrypted with your journal PIN. Account access controls and your sharing choices govern access to photos; this is different from PIN-based encryption of private journal text. A short-lived signed photo link acts as an access credential while valid. Removing app access does not automatically invalidate an already issued link or recall a downloaded copy. The Privacy Policy explains these limits.
FamiJo is not a universal end-to-end encrypted vault. Certain written journal fields are encrypted in server storage, while photos and other data may be protected differently. The journal PIN is an additional access control, not a guarantee that only your device can decrypt all content. Authorized personnel and service providers may have limited access for the purposes described in the Privacy Policy. We do not promise absolute secrecy, perfect security, or that no person can ever access data.
FamiJo account synchronization is not a personal version-history or guaranteed recovery service. Operational backups, where maintained, support service recovery rather than a customer-controlled undo or restore feature. Copies you save or share outside FamiJo remain under your or the recipient's control and must be managed separately. These risk disclosures do not excuse VAV Apps from safeguards or incident notices required by law.
A local draft, cached screen or interrupted upload is not proof that content has reached the server. Check the app's save or upload status, and keep original photos and irreplaceable records separately. Network failures, incomplete synchronization and conflicting changes from different devices can affect availability or the version shown. This explanation does not waive a remedy for a failure for which VAV Apps is legally responsible.
So that leaving a page or closing the app doesn't lose them, FamiJo keeps words you haven't saved yet on the device you typed them on until they are saved, sent or discarded or you sign out there; after two weeks they are no longer offered back and are removed the next time FamiJo opens on that device (Privacy Policy, Section 12).
Reminders and calendar copies are conveniences. A phone can show a reminder late or not at all (for example with notifications turned off, power-saving settings or the app removed), and a calendar shows a change only when it next checks your calendar link, on its own schedule. Do not rely on them where a missed time could cause harm.
8. Acceptable use
You may use the Service only for lawful, personal, family, and permitted business purposes. You may not use the Service to violate applicable law; infringe intellectual property or privacy rights; harass, threaten, stalk, defraud, impersonate, or exploit anyone; distribute harmful or illegal material; or create a risk of harm to a child or other person.
You may not use the Service or its sharing features to plan, organize, advertise, solicit, facilitate, or carry out unlawful activity or transactions. This includes unlawful sale, purchase, distribution, or trafficking of controlled substances, weapons, stolen goods, or other illegal goods or services; fraud, scams, money laundering, exploitation, trafficking, or abuse; or threats, incitement, promotion, or encouragement of violence, self-harm, or harm to another person.
You may not attempt to bypass security, obtain unauthorized access, scrape private data, probe or overload the Service, introduce malware, reverse engineer non-public portions of the Service except where law prohibits that restriction, or interfere with another person's use of the Service.
Child sexual abuse material, sexual exploitation or sexualization of minors, grooming, solicitation of a minor, sextortion, trafficking, and any attempt to procure, create, possess through, distribute, or facilitate such material or conduct are strictly prohibited. This prohibition includes unlawful synthetic or manipulated depictions. Never use the Service to arrange unsafe contact with a child, obtain a child's private information for exploitation, or evade parental, safety, or access controls.
You may not share non-consensual intimate imagery, engage in doxxing, encourage targeted harassment or violence, distribute malicious links, send unsolicited bulk messages, or impersonate another person or organization. Honest private journaling about distress, recovery, victimization, or past experiences is not prohibited merely because it discusses a difficult subject; these Terms prohibit unlawful or harmful conduct, facilitation, exploitation, and prohibited material, not good-faith requests for help.
Do not publish or distribute pornography, sexually explicit material, gratuitous graphic violence, or hateful content targeting people based on protected characteristics through family feeds, groups, invitations, or other sharing features. Do not expose minors to age-inappropriate content or use the Service to arrange sexual or exploitative contact. These rules do not authorize us to monitor all private journaling or guarantee that objectionable content will never appear.
Report a post, a group or a person with Report a concern in the app, through Settings > Help & support > Contact us, or by email to support@famijo.com. Provide the minimum information needed to locate the issue; do not copy, download, forward, or attach suspected child sexual abuse material to a report. For an immediate threat, contact local emergency services. FamiJo is not continuously monitored and is not an emergency reporting channel. We may restrict access, preserve relevant evidence, and notify competent authorities or legally designated reporting bodies when required by law. We do not promise to identify every violation or inspect every private entry.
If an intimate image or video of you, or of someone you are authorized to act for, was shared through FamiJo without consent, you can ask us to remove it whether or not you have a FamiJo account: use Report a concern on the post and choose Sexual content, or email support@famijo.com with the subject Intimate image removal request, your signature, enough information to find the content, a statement that you believe in good faith it was shared without consent, and how to reach you. We remove content covered by a valid request within 48 hours of receiving it and make reasonable efforts to remove known identical copies, as United States law requires.
9. Memberships, purchases, coupons, and promotions
New customer accounts receive a free trial of full-feature access, for the period stated in the app and on famijo.com when the account is created, without payment details. This FamiJo trial does not automatically create or renew a paid subscription. There is no permanent free writing plan. Our paid subscription, FamiJo Pro, is sold monthly or annually through Apple's App Store and Google Play; both periods include the same features, subject to published usage and storage limits. The applicable price and billing period are those disclosed at checkout and confirmed for your purchase, subject to lawful subsequent changes with required notice and consent. A subscription begins upon explicit purchase confirmation, even if unused trial time remains. FamiJo may also provide complimentary access codes, test access, or promotions. When a purchase is made through Apple or Google, the applicable app-store terms and billing rules also apply and control to the extent they conflict with these Terms.
Prices, feature limits, eligibility requirements, and available plans may change prospectively. We will provide notice where required by applicable law or a store policy. Coupons, reviewer access, and promotional access may be limited, revoked, corrected, or expired if issued in error, used outside their stated purpose, or abused.
Before purchasing, review the checkout screen for the current price, currency, taxes, billing period, renewal conditions, and included features. An auto-renewing subscription renews through the billing provider unless canceled under that provider's instructions. Deleting the app, signing out, or requesting FamiJo account deletion does not by itself cancel an Apple or Google subscription. Manage or cancel renewal in the store account used for purchase.
Ordinary cancellation stops future renewal and normally preserves paid access until the stated entitlement end time. A store refund, revocation, payment failure, or other entitlement change can end access sooner. Refund requests, applicable cancellation or withdrawal rights, and billing disputes follow the billing provider's process and mandatory law. These Terms do not promise automatic refunds or waive non-excludable refund rights. We do not impose a blanket no-refunds rule.
Cancellation alone does not create a prorated refund for the unused portion of the current monthly or annual paid period. Cancel before the renewal deadline shown by your billing provider; for Apple subscriptions, allow at least 24 hours before renewal. Any applicable cooling-off, withdrawal, statutory refund, or store-specific cancellation right remains unaffected. Use the store's refund process, or contact support@famijo.com for assistance with billing issues; eligibility is determined under the applicable store rules and mandatory law, not merely by whether you stopped using the Service.
Subscription access is associated with the FamiJo account used to purchase or restore it, rather than with each device separately. Sign in to that same account on supported phones, tablets, and the web. We reconcile store confirmations, renewals, cancellations, billing grace periods, expiry, and refund or revocation events. Changes may take time to reach all devices, particularly while offline or during a provider outage. A displayed last-verified status is not a guarantee of an upcoming charge or a substitute for the store's confirmation. Opening a management or refund link, refreshing access, or restoring purchases does not itself cancel renewal or submit a refund request.
After a trial or subscription expires, saved journals remain readable, but new entries, editing, uploads, and other content-creation features require active access. Content is not deleted solely because a subscription ends. If a free trial ends and the account never has a subscription or other paid or complimentary access, we delete the account and its content 12 months after the trial ended. We keep an account that shares a household, a family group or a co-authored journal with someone who has active access, and one that needs review first (for example, family content other people also use, or an open report). We email the account's address first 9 months after the trial ended (and never less than three months before the deletion), again each month, and three days before, and we confirm by email when it is done. Subscribing at any time before the deletion date keeps the account. Account recovery, deletion, and applicable data-access rights remain available until then. Resuming paid access restores writing without moving your journals. This is not a promise of unlimited or permanent storage; other retention, deletion, suspension, and service-closure provisions still apply.
FamiJo access codes grant the stated promotional entitlement, not cash or a retroactive discount to an existing store purchase. A code does not cancel, credit, or change store billing. Active store subscriptions are subject to the eligibility restrictions displayed before redemption; store-managed offers are governed by the store's offer rules. Test or review access is not a promise of lifetime paid access. Any price change applies prospectively with required notice and any consent the store or law requires.
10. Intellectual property and copyright
Copyright © 2026 VAV Apps LLC. All rights reserved. FamiJo is a product of VAV Apps LLC.
Except for User Content, the Service, software, FamiJo name and logo, Journimals, collectibles, prompts, designs, and related materials are owned by VAV Apps LLC or its licensors and are protected by applicable intellectual-property laws.
Subject to these Terms, VAV Apps grants you a limited, personal, revocable, non-transferable, non-sublicensable right to use the Service for its intended purpose. No other right or license is granted by implication, estoppel, or otherwise.
For an application downloaded from Apple's App Store, Apple's Standard End User License Agreement applies unless a custom application license is expressly provided in that store listing. These Terms govern your relationship with VAV Apps for the FamiJo service; they are not a custom Apple application license and do not replace the applicable software license. Apple is not a party to these service Terms. Mandatory store usage rules and consumer rights prevail over conflicting provisions here. The applicable Google Play terms also govern distribution and purchases through Google Play.
To report suspected copyright infringement, email support@famijo.com with the subject Copyright report. Include your physical or electronic signature; the copyrighted work, or a representative list of works, at issue; the material you dispute and enough information to locate it, such as a post identifier or link; your name, mailing address, telephone number and email address; a statement of your good-faith belief that the use is not authorized by the rightsholder, its agent or law; and a statement that your report is accurate and, under penalty of perjury, that you are authorized to act for the owner of the allegedly infringed exclusive right. Consider fair use and other lawful exceptions before reporting. Do not send account passwords, journal PINs, unrelated private entries or unnecessary information about children. This is a general reporting contact; this procedure does not represent that VAV Apps has registered a statutory copyright agent or qualified for a particular safe harbor.
We assess reports, may request missing information, and remove or restrict content when warranted by applicable law or these Terms. For a valid notice handled under the United States Digital Millennium Copyright Act (DMCA), we act expeditiously to remove or disable access to the identified material and promptly notify the uploader. A report is not a court determination of infringement, and submitting a report does not automatically remove content or terminate an account. Other privacy, safety and unlawful-content concerns may also be reported to support@famijo.com without claiming copyright ownership.
If your content was removed through the DMCA procedure because of mistake or misidentification, you may send a counter-notification to the contact identified in the removal notice. Include your physical or electronic signature; the removed material and its former location; a statement under penalty of perjury of your good-faith belief that removal resulted from mistake or misidentification; your name, address and telephone number; and a statement that you consent to the jurisdiction of the United States Federal District Court for the judicial district of your address, or, if outside the United States, any judicial district in which VAV Apps may be found, and will accept service of process from the original complainant or their agent. Seek legal advice if unsure about these statements. Knowingly making a material misrepresentation in a notice or counter-notice may result in legal liability.
A compliant DMCA counter-notification, including its required contact information, is forwarded to the original complainant. Under that procedure, removed material is restored not fewer than 10 and not more than 14 business days after receipt of the counter-notification unless we first receive notice that the complainant has filed a court action seeking to restrain the allegedly infringing activity. An independently applicable legal restriction or violation of another provision of these Terms may require a separate restriction; we will explain the basis where lawful. Do not submit a counter-notification unless you understand the required disclosure of your information. We share other reporting information only as reasonably needed to evaluate or respond to the report, permit review, or comply with law, as described in the Privacy Policy.
Repeat-infringer policy: VAV Apps will terminate, in appropriate circumstances, accounts of users who repeatedly infringe copyright. In applying this policy, we consider reliable evidence, valid notices, retractions, counter-notifications and relevant judicial determinations rather than treating every unverified accusation as an established infringement. We may restrict content or accounts sooner where legally justified. Affected users may request review at support@famijo.com. Do not evade an account restriction by opening or using another account. This policy requires actual implementation and does not itself establish eligibility for a statutory safe harbor.
11. Suspension, termination, and service changes
We may modify, suspend, or discontinue any part of the Service, or restrict or terminate access, when reasonably necessary for security, abuse prevention, legal compliance, technical maintenance, third-party platform requirements, or business operations. Where practicable, we will provide notice of material changes.
We may investigate, preserve information, remove or restrict access to content, and report or disclose information when reasonably necessary to comply with law, respond to valid legal process, investigate suspected abuse or security incidents, or protect people, rights, property, and the Service. We do not undertake to monitor every private entry or shared item.
You may stop using the Service at any time. You can delete your account in Settings > Privacy & data > Delete my account (famijo.com/delete-account explains it for people without the app), confirmed with your password or a code we email you. Your account is locked at once and deleted 30 days later; until then, signing in and choosing Keep my account cancels the deletion. Journals other people write in, and a family with other adults in it, are left to someone you choose rather than deleted; child sign-ins you set up are paused and then deleted with the account; reports other people made are kept. You may also ask support@famijo.com from your account's email address. Deletion is subject to the retention, backup, legal, and technical limits described in the Privacy Policy.
Where reasonably practicable and lawful, we will explain a material account restriction and provide a way to ask for review through support@famijo.com. Advance notice may be inappropriate for an urgent security risk, child-safety concern, prohibited content, or legal restriction. For a planned permanent service closure, we will make reasonable efforts to give notice and an opportunity to export available data, subject to law and technical feasibility. Nothing here authorizes withholding a legally required privacy response because you decline revised Terms.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." VAV APPS DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, UNINTERRUPTED OPERATION, ERROR-FREE OPERATION, AND DATA PRESERVATION.
WITHOUT LIMITING THE FOREGOING, VAV APPS DOES NOT WARRANT THAT THE SERVICE, CONTENT, BACKUPS, OR TRANSMISSIONS WILL BE CONTINUOUS, TIMELY, SECURE, ERROR-FREE, IMMUNE FROM ATTACK, OR AVAILABLE OR RECOVERABLE AT ANY PARTICULAR TIME. WE DO NOT WARRANT THAT ERRORS, DEFECTS, OR SECURITY VULNERABILITIES WILL BE IDENTIFIED OR CORRECTED ON A PARTICULAR SCHEDULE.
Some jurisdictions do not permit certain exclusions of warranties. In that case, those exclusions apply only to the extent permitted by law. Nothing in these Terms excludes a right that cannot lawfully be excluded.
For consumers entitled under mandatory law to services provided with reasonable care and skill, digital content that conforms to its description, or correction, replacement, price reduction or refund for a covered failure, those rights and remedies remain available. The risk warnings in these Terms do not mean that you bear losses which the law makes VAV Apps responsible for, or excuse misleading descriptions of the Service.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VAV APPS AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, MEMORIES, PHOTOS, PROFITS, GOODWILL, ACCOUNT ACCESS, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THESE EXCLUSIONS AND THE CAP BELOW APPLY TO CLAIMS ARISING FROM OR RELATING TO UNAUTHORIZED ACCESS TO, LOSS, CORRUPTION, ALTERATION, DELETION, MISDELIVERY, DELAY, OR UNAVAILABILITY OF CONTENT OR ACCOUNT DATA; SECURITY INCIDENTS OR ATTACKS; ACCOUNT OR CREDENTIAL COMPROMISE; YOUR OR A RECIPIENT'S SHARING CHOICES; THE ACTS OR OMISSIONS OF OTHER USERS, CONNECTED SERVICES, NETWORKS, APP STORES, OR SERVICE PROVIDERS; OR YOUR INABILITY TO RESTORE A BACKUP. THEY APPLY REGARDLESS OF THE LEGAL THEORY, WHETHER OR NOT WE WERE ADVISED THAT DAMAGE WAS POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VAV APPS' TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO VAV APPS FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $100. These limits apply even if a remedy fails of its essential purpose and do not limit liability that cannot lawfully be limited.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence where such a limitation is prohibited, or any other liability or statutory remedy that applicable law does not permit us to exclude or limit. Mandatory consumer guarantees, data-protection obligations, and legally required security-incident notices remain applicable. A user's acceptance is not a release of unknown statutory claims or permission for VAV Apps to act unlawfully.
14. Indemnification
If you have reached the age of majority and applicable law permits this obligation, you are responsible for reasonable, documented losses and defense costs arising from a third-party claim only to the extent caused by your intentional unlawful use of the Service, fraudulent misrepresentation, or knowing violation of another person's rights. This is not an obligation to pay merely because you wrote a journal entry, reported an issue in good faith, exercised a privacy right, or made a complaint against VAV Apps.
This obligation excludes losses attributable to VAV Apps' or its providers' breach of duty, negligence, unlawful conduct, or failure to follow your authorized instructions. It does not require a consumer to assume a liability that mandatory law places on VAV Apps or to pay penalties that cannot lawfully be shifted. It does not apply to a minor.
We must give reasonably prompt notice of the claim and a reasonable opportunity to participate in its defense, take reasonable steps to limit avoidable loss, and substantiate any amount sought. We may not bind you to a settlement, admission or payment without your agreement. This provision does not authorize an automatic charge to your payment method or impose a contractual penalty. Mandatory consumer protections remain controlling.
15. Governing law and general terms
Except where applicable consumer-protection law requires otherwise, these Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Before bringing a claim, you agree to contact support@famijo.com and give us a reasonable opportunity to resolve the issue informally.
Subject to mandatory law and the jurisdiction of the court concerned, disputes may be brought in competent state or federal courts in Washington on a non-exclusive basis. This is not an exclusive venue requirement: it does not prevent a consumer from using another court available under applicable law, including a competent court where the consumer lives, or an available small-claims procedure.
If a provision of these Terms is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, reorganization, or sale of assets, subject to applicable law.
The informal contact request does not prevent urgent relief, a complaint to a regulator, or timely exercise of a legal right. These Terms do not impose mandatory arbitration or a class-action waiver. Obligations concerning accrued payment, permitted retained copies, intellectual property, lawful liability limits, and dispute resolution survive termination only to the extent their nature and applicable law require. The Terms, applicable purchase disclosures, and referenced notices form the agreement for the Service, without overriding mandatory local protections.
If you are a consumer outside the United States, the Washington-law provision does not deprive you of mandatory protections, available local courts, regulator complaints, statutory remedies or privacy rights that apply where you habitually reside. The Service may be limited by country or feature where legal or platform requirements cannot be met. No Terms acceptance authorizes unlawful international data transfers or removes VAV Apps' own obligations for providers it uses.
The Service relies on contracted cloud hosting, database and storage providers. Available infrastructure regions depend on the providers and configurations selected by VAV Apps. FamiJo does not currently offer a user-selectable data region, automatic country-based routing or a commitment that all processing remains in your country. The Privacy Policy explains international processing and applicable protections. Provider capabilities do not replace VAV Apps' duties to comply with applicable data-localization, transfer or consumer-protection requirements; where a requirement cannot be met, the affected service must not be offered.
16. Changes and contact
We may revise these Terms when the Service, laws, or platform requirements change. Each published revision has a version identifier and publication date. The app asks existing account holders to review and affirmatively accept a new Terms version before continuing affected account features; it does not infer renewed acceptance from silence or continued browsing. Revisions apply prospectively upon acceptance or a later effective date stated in the notice, not retroactively to an existing dispute. Where law requires advance notice or a separate consent, that requirement still applies.
First-time agreement review presents the current Terms and privacy notices without describing them as changes to an earlier agreement. Subsequent review identifies the documents being presented and summarizes the publication's updates. We retain records of accepted document versions and acceptance times; the post-sign-in review process also records a publication fingerprint linked to archived text. If you decline, you can sign out, manage an existing subscription through its billing provider, and contact support about a copy of your data, deletion, or other rights without accepting. Declining does not itself delete your data or cancel a subscription. Merely opening a subscription-management link does not cancel renewal or request a refund; the store's process and applicable local law govern those actions.
